Bhavani ... 3rd Respondents/Defacto Complainant PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the learned District and Sessions Judge (PCR Act Cases), Madurai, to consider the bail application of the petitioners on the same day of surrender in Crime No.2110/2020 on the file of the Inspector of Police, Melur Police Station, Madurai District, the 2nd respondent herein.

O R D E R

The petitioners are the Accused Nos.3, 4, 5 and 7 in Crime No.2110 of 2020 on the file of Melur Police Station, Madurai District and the offences alleged against the accused are under Sections 147, 294(b), 323 IPC and 3(2)(va) of Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015 and under Section 4 of TNPHW Act.

2. The present petition filed by the petitioner is to accept the surrender of the petitioners before the learned District and 1/3

Sessions Judge (PCR Act Cases), Madurai, in connection with the Crime No.2110 of 2020 on the file of the second Respondent police and to consider the bail application filed by the petitioners on the same day.

3. Mr.R.M.Anbunithi, learned Additional Public Prosecutor (Crl. Side) accepts notice for the respondents 1 and 2.

4. Since the prayer itself is to accept the surrender of the petitioners and consider the bail application, this Court is inclined to pass the following orders :-

1) The petitioners should appear before the learned District and Sessions Judge (PCR Act Cases), Madurai, within a period of 15 days, from the date of receipt of a copy of this order; and

2) On such surrender, the Court concerned, may consider the bail application filed by the petitioners on merits on the same day of surrender, after giving notice to the concerned Public Prosecutor and by complying Section 15(5) of the Act.

5. With the above observation, this Criminal Original Petition is disposed of.
