O R D E R
The petitioner seeks for issuance of a Writ of Mandamus directing the respondents 1 to 6 to remove the lock and seal at the premises of the petitioner situated at Survey NO.2/1, Angadimangalam 1st bit Village, Sakkudi Vilakku, Madurai East, Madurai District based on the petitioner's representation dated 02.05.2015.
2. Heard the learned Counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents.
3. The petitioner is the owner of the building in Survey NO.2/1, Angadimangalam 1st bit Village, Sakkudi Vilakku, Madurai East, Madurai District, sought for removing the lock and seal of the premises, which has been fixed by the respondents. The petitioner would state that the premises is alleged to have been used by other persons for mixing waste bricks in the PDS rice and in this regard, six persons have been arrested and four of them have been detained under the Tamil Nadu Act 14, 1982 and the orders of detention has been passed recently. The petitioner stated that though he has been made one of the accused in the F.I.R., there is no specific overt act as against the petitioner.
4. In my view it is too early for this Court to render any findings in this writ petition, since the case is only at preliminary stage and the four persons have been detained under the Tamil Nadu Act 14, 1982. Hence, the prayer sought for in this Writ Petition cannot be granted at this juncture.
5. Accordingly, the Writ Petition is dismissed. No costs. Consequently, the connected Miscellaneous Petition is also closed. However, this order will not prevent the petitioner to relinquish his grievance after reasonable time.
