PRAYER :- For Anticipatory Bail in Crime No.486 of 2023 on the file of the respondent police ORDER : The Court made the following order :- The petitioners/Accused rank not known, who apprehend arrest at the hands of the respondent police for the offences punishable under sections 3(2)(a), 4(1), 4(2)(c) of Immoral Traffic (Prevention) Act, 1956 and Section 370 of IPC, in Crime No.486 of 2023 on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that on 17.04.2023, when the defacto complainant was standing at 11th Cross, Thillai Nagar, the accused persons came and introduced themselves that they are running an Ayurvedhic Spa and they have five ladies and if the defacto complainant wants to have fun with the girls, he has to pay Rs.3,000/- to Rs.5,000/-. 3. The learned counsel for the petitioners submitted that the 1/2
CRL OP(MD). No.7622 of 2023 petitioners are innocent persons and they have been falsely implicated in this case.
4. The learned Additional Public Prosecutor appearing for the respondent submitted that the petitioners are the owners of the Spa, A2 has three similar previous cases and four victims have been rescued from the petitioners' spa.
5. Heard both side and perused the materials available on record including the First Information Report.
6. Taking into consideration of the facts and circumstances of the case and A2 has three similar previous cases and also the fact that four victims are rescued from the Spa, the custodial interrogation of the petitioners is very much required. Since the petitioners committed very serious offence as against the society, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the Criminal Original Petition is dismissed.
