JUDGMENT

(By G.R.SWAMINATHAN, J.) Heard both sides.

2.The case on hand pertains to the appointment of the first respondent herein as craft teacher. The learned single Judge had directed that the appointment must be approved. Assailing the same, the department has filed this Writ Appeal.

3.The learned Special Government Pleader appearing for the appellants would state that the students strength as on date is hardly 265. 4.In our view, this factor is not relevant. What has to be considered is the students strength that prevailed at the time when the appointment order was 2/4

issued in favour of the first respondent. At that time, the students strength was

670. Therefore, the subsequent fall in the students' strength cannot be put against the writ petitioner. The subsequent development may lead to redeployment of the writ petitioner. On this ground, the approval of the appointment cannot be denied.

5.This Writ Appeal stands dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
