ORDER : The Court made the following order :- The petitioner/Accused, who was arrested on 02.01.2024 for the offences punishable under Section 5(l) r/w. Section 6 of POCSO Act, 2012 @ under Section 5

(1) r/w. Sections 6 and 14 (1) of POCSO Act, 2012 and under Sections 201, 506 (ii) 1/3

I.P.C., in Crime No.38 of 2023 on the file of the respondent police,seeks bail. 2.The case of prosecution is that the accused has sexually assaulted the victim girl from the year 2016, a minor then, who is now aged about 19 years. Hence, the complaint.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution. The petitioner is in custody from 02.01.2024. Hence, he prays to release him on bail. 4.The learned Additional Public prosecutor would submit that the petitioner has committed sexual assault against the victim, who was a minor at the time of occurrence, ie. in the year 2016. The victim's parents are working in a flower shop which was run by the petitioner/accused. The victim girl is now aged about 19 years.

5. Considering the facts and circumstances of the case and considering the nature of offence, this Court is not inclined to grant bail to the petitioner.
