: Respondents Prayer: Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Habeas Corpus, directing the first and second respondents to produce the detenu, namely Siva Gowtham, S/o.Subramanian, aged about 19 years, before this Court and set him at liberty forthwith.

ORDER

(Order of the Court was made by M.V.MURALIDARAN, J.) One Subramanian has filed this Habeas Corpus Petition alleging that his son, viz., Siva Gowtham, aged about 19 years, was found missing from 22.08.2016. In this regard, a complaint has been given to the respondent police on 25.08.2016 and based on the same, a case was registered in Crime No.576 of 2016 for man missing. However, no action was taken so far to trace out the detenu. Hence, he has come up with the present Habeas Corpus Petition.

2. When the matter was taken up for hearing, the learned Additional Public Prosecutor, on instructions from the respondent police, informs this Court that the detenu eloped with one Sanjeegai, who has got already married and now, they are hiding elsewhere.

3. Since the detenu is a major, recording the submission made by the learned Additional Public Prosecutor, the Habeas Corpus Petition is closed, by giving a direction to the respondent police to expedite the investigation.
