Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the 1st respondent to conduct enquiry under section 22A of the Registration Act in respect of Survey No.190/4, Thethupatti Village, Dindigul Taluk and District, as per the order passed by this Honourable Court in W.P(MD)No.3981 of 2023, dated 27.02.2023, and register the decree made in O.S.No.338 of 2012 passed by

the Additional District Court, Dindigul, dated 25.11.2022, by considering petitioner's representation, dated 11.03.2025. For Petitioner :

ORDER

The petitioner seeks for an enquiry to be conducted in terms of the order passed by this Court in W.P.(MD) No.3981 of 2023, dated 27.02.2023. Pursuant to the said order, the petitioner presented the decree for registration on 09.05.2023; yet, the enquiry, as required by the order of this Court, has not been conduced so far.

2. I have heard Mr.Adithya Vijayalayan for the petitioner; Mr.P.T.Thiraviyam for the first respondent; and Mr.Riyash Ahamed for Mr.D.S.Haroon Rasheed for the second respondent - Wakf Board.

3. Mr.P.T.Thiraviyam submits that they will complete the enquiry as directed by this Court within a period of three weeks from today.

4. The above submission is recorded as an undertaking given by the first respondent to this Court.

5. Accordingly, there shall be a direction to the first respondent to complete the enquiry within the time sought for by him, as above.

6. Writ Petition is allowed accordingly. No costs. 17.04.2025 NCC :
