: Respondents PRAYER: Habeas Corpus Petition is filed under Article 226 of the Constitution of India to issue a Writ of Habeas Corpus, directing the respondents to produce the body or person of the petitioner minor daughter detenu namely Aarthy D/o.Manoharan, aged about 16 years 9 months before this Court and hand over the custody to the petitioner.

O R D E R

[Order of the Court was made by M.V.MURALIDARAN, J.] The petitioner is the father of the detenu viz., Aarthy, aged about 16 years and 9 months. He gave a complaint to the 2nd respondent Police alleging that the detenu has been found missing from 15.09.2016. Based on the same, a case has been registered in Crime No.323 of 2016 for girl missing. Thereafter, no action was taken by the 2nd respondent Police. Therefore, the petitioner has come up with this Habeas Corpus Petition.

2.We have heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3.Today, the second respondent Police produced the detenu viz., Aarthy, before this Court. On our enquiry, she stated that she went to Tiruppur along with her friend, since her father had scolded him for the low marks obtained in +2 examinations and that now she is willing to go back with the petitioner. The petitioner is also willing take back her. The said statement is recorded.

4. In view of the same, the Habeas Corpus Petition is closed entrusting the custody of the detenu to the petitioner. Sd/- Assistant Registrar(AE) /True copy/ Sub Assistant Registrar To 1.The Superintendent of Police, Thanjavur District, Thanjavur.
