Writ petition is filed under Article 226 of the Constitution of India praying for an issuance of a writ of mandamus to direct the respondents to issue fresh tender notification relating to the works under THAAI scheme 2015-16.

ORDER

The petitioner seeks for issuance of a writ of mandamus directing the respondents to issue fresh tender notification in respect of the works allotted vide tender notification dated 21.04.2015.

2. By consent, the writ petition is taken up for final disposal.

3. Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents.

4. The petitioner claims to be a registered Contractor and would submit that he was not aware of the tender notification dated 21.04.2015 and it was not published in the manner known to law.

5. The learned counsel for the respondent submitted that the tender has been opened on 29.04.2015 itself.

6. Under such circumstances, issuance of fresh notification does not arise. However, if the petitioner has got further grievance on the award of work, it is open to the petitioner to adjudicate the same in the manner known to law.
