Writ petition is filed under Article 226 of the Constitution of India praying for an issuance of a writ of mandamus to direct the 1st respondent to consider the petitioner's representation dated 12.05.2015 and release the vehicle bearing Registration No.TN 65 V 2802 in connection with Crime No.132/2015.

ORDER
The petitioner seeks for issuance of a writ of mandamus directing the 1st respondent to consider the petitioner's representation dated 12.05.2015 and release the vehicle bearing Registration No.TN 65 V 2802 in connection with Crime No.132/2015.
2. By consent, the writ petition is taken up for final disposal.
3. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents.
4. The petitioner's vehicle has been seized for alleged transportation of PDS rice. It is stated that the petitioner is not an accused in the criminal case.
5. The learned Additional Government Pleader, on instructions, submitted that proceedings have been initiated under the provisions of Essential Commodities Act for confiscation by the first respondent and a notice in this regard was issued for the hearing date on 08.05.2015. Subsequently, hearing date has been adjourned to 22.05.2015, since the petitioner did not appear.
6. In the light of the above, the question of granting an order to release the vehicle, at this juncture, is not proper, since confiscation proceedings has already been commenced. Accordingly, there will be a direction to the petitioner to appear for the enquiry before the first respondent on 22.05.2015 and if the petitioner appears for enquiry, the first respondent shall consider the petitioner's submission and pass orders within a period of two weeks therefrom. The writ petition stands disposed of with the above direction. No costs.
