Writ petition is filed under Article 226 of the Constitution of India praying for an issuance of a writ of mandamus to direct the respondents 6 and 7 not to interfere with the right to worship, management, administration and ongoing maintenance work and repair work in Sri Pon Vandu Ayyanar Temple, North Street, Thandupathu, Thiruchendur Taluk and Thoothukudi District by misusing their police power. ORDER

The petitioner seeks for issuance of a writ of mandamus directing the respondents 6 and 7 not to interfere with the right to worship management, administration of the Temple.

2. By consent, the writ petition is taken up for final disposal.

3. Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents.

4. The learned Special Government Pleader, on instructions, submitted that the 8th respondent and his group of persons have been granted permission by all the authorities and there is an attempt made by the petitioner to interfere with the said rights and therefore, a criminal complaint was filed and a case has been registered against the petitioner and the same is pending investigation.

5. From the affidavit filed in support of the writ petition, it is seen that there is civil dispute pending between the parties. Therefore, at this juncture, no such direction as sought for by the petitioner can be granted.

6. In view of the above, the writ petition held to be not maintainable and accordingly, the same is dismissed. No costs. Consequently connected Miscellaneous Petition is closed.
