Petition filed under Article 226 of the Constitution of India, praying for issuance of a writ of Habeas Corpus directing the respondents 1&2 herein to produce the body or person of petitioners minor son G.Prabhakaran aged 17 years from the illegal custody of the 3rd respondent herein before this Honourable Court and hand over the custody to the petitioner. ORDER

(Order of the Court was made by S.NAGAMUTHU, J.) The petitioner, who is the father of one Prabhakaran, who is aged 17 years (date of birth is 12.11.1999), has been found missing. Pursuant to which, he has given a complaint to the respondents. Since the 2nd respondent has not taken any action, he has come up with this petition.

2. Today, when the matter was taken up, the 2nd respondent produced the detenu. The detenu told us that because of some quarrel between him and his father, he went to Trivandrum and got employment in a private Institution and he has further stated that he has got nothing to do with the third respondent. https://hcservices.ecourts.gov.in/hcservices/

3. The petitioner submitted that out of suspicion, he made allegations against the third respondent. Therefore the allegations made by the petitioner against the third respondent shall stand expunged. Since the detenu has not been detained by anybody illegally, this petition is disposed of giving liberty to the petitioner to take back the detenu to his custody.
