Prayer:- Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, to direct the respondents 1 and 2 particularly 2nd respondent to dispose of the petitioner's representation dated 27.03.2015 submitted to take appropriate action against the 3rd, 4th and 5th respondents. ORDER

The petitioner has filed this Writ Petition for issuance of Writ of Mandamus to direct the respondents 1 and 2, particularly the second respondent to dispose of the petitioner's representation dated 27.03.2015 to take appropriate action against the respondents 3 to 5.

2. After hearing the learned Additional Government Pleader and the learned counsel appearing for the fifth respondent, it is come to light that the fifth respondent is the first wife of Varatharaj Pillai and the petitioner claims to be the second wife of the said Varatharaj Pillai. After the demise of Varatharaj Pillai, there is a dispute between the petitioner and fifth respondent and a Suit for partition is pending in Original Suit No.30 of 2015 on the file of the Additional District Court, Dindigul. In the interregnum period, there appears to have been problems between them and the petitioner as well as fifth respondent have given https://hcservices.ecourts.gov.in/hcservices/

criminal complaints against each other and two First Information Reports are pending in Crime Nos.50/2015 and 68 of 2015 on the file of Thandikudi Police Station and Pattiveeranpatti Police Station respectively.

3. The learned Additional Government Pleader, on instruction, would submit that FIR has reached only recently and investigation has been done in proper manner.

4. In the light of the above, parties have to settle the issue before the Civil Court and allow the police officials to investigate both the Crime Numbers in the manner provided under law. It is made clear that under the guise of investigating the said Crime Numbers, there shall not be any harassment to either party.
