To modify the Decree and Judgment dated 26-11-2021 made in MCOP.No.810 of 2017 on the file of Learned Special Sub Judge, Tirunelveli.

ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.A.ILANGO, Advocate for the petitioner, while admitting the Civil Miscellaneous Appeal, the court made the following order:- On the side of the petitioner, it is stated that the appellant is only against the quantum and the petitioner is ready to deposit the admitted amount, that is, Rs.7,09,677/-.

2.In view of the same, this petition is allowed and there shall be an order of Stay on condition that the petitioner/appellant shall deposit Rs.7,09,677/-, with proportionate interests and costs, awarded in M.C.O.P.No.810 of 2017, on the file of the Motor Accident Claims Tribunal - Special Sub Court, Tirunelveli, within a period of four weeks from today, after deducting the amount already https://www.mhc.tn.gov.in/judis 1/2

CMP(MD) No.6607 of 2022 deposited by him, if any, to the credit of M.C.O.P.No.810 of 2017, on the file of the Motor Accident Claims Tribunal - Special Sub Court, Tirunelveli, failing which, interim stay granted shall stand automatically dismissed.
