ORDER

Seeking to direct the respondents 1 and 2 to provide adequate police protection to enable the removal of unauthorized shed put up by the 3rd and 4th respondents the petitioner's property considering the petitioner's representation, dated 16.03.2026, this writ petition is filed.

The learned counsel for the petitioner submitted that proper survey was conducted by the revenue authorities and it has been identified that the 3rd and 4th respondents had encroached upon the petitioner's property by putting up an unauthorized shed. In this regard, representation has already been given by the petitioner to the respondents 1 and 2 to give adequate police protection to enable the removal of the unauthorized shed. However, the same is not considered. Hence, this writ petition.

3. The learned Government Advocate(Crl.side) submitted that as claimed by the petitioner, the same is not exclusively the petitioner's property. It is a Natham Poramboke land, about which both the petitioner as well as the private 2/5

respondents are claiming rights.

4. Heard the learned counsel for the petitioner and the learned Government Advocate(crl.side) for the respondent police. Notice has been served upon the 3rd and 4th respondents. However, none appeared on behalf of the 3rd and 4th respondents, either in person or through counsel.

5. The 2nd respondent police is directed to issue summons to the petitioner as well as the private respondents under Section 64 BNSS and after giving an opportunity of hearing to both the parties. If the petitioner's claim is found to be true on perusal of the documents produced by the petitioner, the 2nd respondent police is directed to take necessary steps directing the 3rd and 4th respondents to remove the unauthorized put up by them in the petitioner's property. If the 3rd and 4th respondent fails to comply with the order, the petitioner is at liberty to approach the appropriate forum in the manner known to law.
