This Writ Petition is filed seeking a direction to the first respondent to transfer the patta from the name of petitioner's husband Masilamani to the petitioner's name based on the report submitted by the third respondent dated 31.03.2023.
2. Heard the arguments of Mr.G.Kannan, learned counsel for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondents.
3. According to the petitioner, the subject property was purchased by her husband and patta for the same stands in his name in patta No. 1190. The petitioner's husband executed a settlement deed on 15.02.2022, settling the subject property in her favour. Based on the said settlement deed, the petitioner applied for transfer of patta. The same has not been considered. Hence, a Writ Petition was filed before this Court in W.P.(MD)No.1895 of 2022 and the same was disposed of by directing the 2nd respondent herein to conduct enquiry on the application submitted by the petitioner and pass final orders. Thereafter, enquiry was conducted and third respondent submitted a report before the first respondent in his proceedings in Na.Ka.No.A1/3272/2022 dated 2/4
31.03.2023. In spite of the same, the first respondent has not passed any order till date. Therefore, the petitioner submitted yet another representation on 06.04.2023 before the first respondent requesting him to consider the report submitted by the third respondent and pass orders for transfer of patta in her name. The same has not been considered. Hence, the petitioner has come before this Court.
4. The learned Additional Government Pleader appearing for the respondents would submit that the representation of the petitioner would be considered in accordance with law.
5. In view of the same, without expressing any opinion on the merits of the matter, the first respondent is directed to consider the representation of the petitioner dated 06.04.2023 and pass final orders on its own merits within a period of four (4) weeks from the date of receipt of a copy of this order.
6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
