Respondents Prayer: Habeas Corpus Petition is filed under Article 226 of the Constitution of India praying for issuance of a writ of Habeas Corpus directing the respondents 1 and 2 to produce the body of the petitioner's daughter namely Kalaimathi, aged about 23 and son-in-law namely Suresh Kumar, S/o. Vethiappan aged about 31 years before this Court.

O R D E R
(Order of the Court was made by T.S.SIVAGANAM,J.) The Habeas Corpus Petition has been filed by one Murugan seeking to produce his daughter Kalaimathi and her son-in-law Suresh Kumar, who according to the petitioner, were illegally detained at the behest of the third respondent, the uncle. The petitioner would accept that his son-in-law has returned, but would state that his daughter is not traceable. The respondent police has made investigation and found out that the petitioner's wife has been speaking to the daughter Kalaimathi, who appears to be somewhere in Mumbai.

2. Thus, it is clear that the third respondent has not detained either the petitioner's daughter or the son-in-law. If the son-in-law has already come back and joined the petitioner, it is not known as to why the petitioner is still pursuing this petition, more so, when his wife is speaking to her daughter regularly. Therefore, there is no question of any illegal detention and no useful purpose would be served in keeping this Habeas Corpus Petition pending. Accordingly, this petition is closed. While closing this petition, the petitioner is directed to co-operate with the investigation of the second respondent police, who shall take all steps to investigate and ascertain the whereabouts of the petitioner's daughter Kalaimathi.
