For Respondent : Mr.R.M.Anbunithi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.130 of 2023 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner/A2 who apprehends arrest at the hands of the respondent police for the offences punishable under Section 420 of I.P.C., in Crime No. 130 of 2023 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner along with A1 had created false documents by using the Aadhar card of the defacto complainant and obtained a loan of Rs.3,00,000/- from Co-operative ABNL and thereby cheated her. Hence, the case. 3.Heard. Perused the materials available on record including the First Information Report.
4.It is seen that the husband of the defacto complainant died while he was in service. The first accused is the co-worker of the deceased in the same department. In the name of the deceased person, A1 with the help of the petitioner received all records from the defacto complainant's family and availed loan to the tune of Rs.3,00,000/-. CRL OP(MD). No.7631 of 2023 respondent, in which, the accused person was ready and willing to settle the entire loan amount, thereafter they failed to settle the amount. Hence, FIR has been registered.
5.The petitioner obtained all the documents of the deceased from the defacto complainant and thereby, availed loan. Therefore, the custodial interrogation of the petitioner is very much required. Hence, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the Criminal Original Petition is dismissed.
