For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.265 of 2020 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/A1, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 341,294(b),427 and 506(ii) of IPC in Crime No.265 of 2020, seeks anticipatory bail.

2.The case of the prosecution is that the accused in this case claims himself to be a big rowdy and challenging everyone in the locality. On 15.12.2020 at about 09.15 hrs when the defacto complainant and one Suresh were talking near Adithanar street and they proceeding towards his house. When he reached the A.P.Nagar water tank at about 9.30 hrs the accused waylaid them attacked him with aruval. They also torn the seat cover of the two wheeler. Therefore, this case came to be registered.

CRL OP(MD). No.9123 of 2021 3.The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case.

4.The learned Government Advocate (Crl.side) for the respondent strongly opposed this petition on the ground that the three previous cases are pending against the petitioner in Crime Nos.25 of 2018, 164 of 2020 and 260 of 2017. He would also submit that the petitioner is a history sheeter rowdy in H.S.No.57 of 2020.

5. Taking note of the facts and circumstances of the case and also the fact that three previous cases are pending against the petitioner and the fact that the petitioner is a history sheeter rowdy in H.S.No.57 of 2020, this Court is not inclined to grant anticipatory bail to the petitioner.
