Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents 1 to 4 to take appropriate action as against the respondents 5 and 6 in accordance with law by considering the petitioner's representation 09.11.2022 within a stipulated period as framed by this Court.

O R D E R

This Writ Petition has been filed seeking a direction to the respondents Nos.1 to 4 to take appropriate action against the respondent Nos.5 and 6 in accordance with law, by considering the petitioner's representation dated 09.11.2022 within a time frame to be fixed by this Court.

2. The grievance of the petitioner is that the drivers and the conductors are being deputed to other duties even though they are in good health. He would further submit that persons who do not come 2/5

under the purview of the Rights of Persons with Disabilities Act, 2016 are being treated as disabled, which renders the Act nugatory and defeats the rule of law. Hence, he apprehends that he would be prejudiced. In this regard, the petitioner has submitted a representation to the respondent Nos.1 to 4 on 09.11.2022 seeking appropriate action against the respondent Nos.5 and 6.

3. The learned Standing Counsel appearing for respondent Nos.5 and 6 would submit that the respondent Nos.5 and 6 have not shown any partiality between the employees as alleged by the petitioner.

4. Considering the submissions made by the learned counsel on either side, this Court is not inclined to direct the respondent Nos.1 to 4 to take action against the respondent Nos.5 and 6. If the petitioner has any grievance, he is at liberty to submit a representation before the respondent Nos.5 and 6.

5. In view of the above, the Writ Petition stands dismissed. However, liberty is granted to the petitioner to work out his remedy by making a representation before the respondent Nos.5 and 6 within a 3/5

period of four weeks from the date of receipt of a copy of this order. On receipt of such representation, the concerned respondent shall consider and dispose of the same within a period of four weeks thereafter. There shall be no order as to costs.
