O R D E R
This petition is filed seeking a direction to the second respondent police and his officials not to harass the petitioner and her family members in the guise of enquiry based on the complaint of the third respondent.
2. The learned Additional Public Prosecutor submitted that on the basis of the complaint given by the third respondent herein, enquiry has been undertaken in C.No.39 of 2020 on the file of the Economic Offences Wing Part-2, Tirunelveli, wherein it has been stated that the petitioner and the third respondent are neighbors and the petitioner has stated that she is a Clerk in Indian Bank and if Fixed Deposits made, more interest will be given and on that basis, the wife of the third respondent paid Rs.1 lakh, but, instead of depositing the same in the Indian Bank Fixed Deposit Account, she credited the amount to one Baba chit fund and later it came to know that she is working as a agent in the said Baba Chit Fund.
3. The learned counsel for the petitioner submits that the petitioner is also a victim and she has also deposited the amount in the above said Chit Fund and the owner of the chit fund cheated the https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P.(MD)No.9140 of 2021 public and went hiding. Even though she appeared before the police twice and there was pressure on the side of the second respondent to settle the amount.
4. Heard both sides.
5. The second respondent has no right to pressurize the petitioner to settle the amount as he has to act as per law. The petitioner is directed to co-operate with the enquiry. But however subject to process of legality in taking decision, the second respondent shall act.
6. With the above direction, this Criminal Original Petition is disposed of.
