ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent for the offences punishable under Sections 8(c), 20(b)(ii)(c) and 25 of NDPS Act, in Crime No.42 of 2026, on the file of the respondent police, seeks anticipatory 1/4

bail.

2. The case of the prosecution is that on 18.03.2026, at about 22"10 hours, based on secret information, the respondent intercepted the accused's vehicle and found that 11 pockets of Ganja weighing about 22.610 kgs. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioner is innocent and he was falsely implicated in this case and he is no way connected in the above said incident. He has not committed any offence as alleged by the prosecution. No contraband was recovered from this petitioner. Only for statistical purpose, the respondent police implicated this petitioner. Hence, he prays to grant Anticipatory Bail to the petitioner.

4. The learned Additional Public Prosecutor fairly submits that the offences are grave in nature. The quantity involved in this case is huge commercial quantity. On seeing the police officials, the accused were ran away. The petitioner is the sole accused in this case. Investigation is in initial stage. The petitioner has four previous cases, similar in nature. Hence, he vehemently opposed the grant of anticipatory bail to the petitioner. 2/4

5. Heard both sides and perused the materials available on record.

Considering the rival submissions on either side and the nature of offences charged against the petitioner, and considering the quantity of contraband involved, which is commercial quantity, that the petitioner is having four previous cases for the similar kind of offence, investigation is at the initial stage, this Court is declined to grant bail to the petitioner at this stage. 7.Accordingly, this criminal original petition is dismissed.
