Respondents PRAYER: Habeas Corpus Petition has been filed under Article 226 of the Constitution of India, praying to direct the respondents 1 to 3 to produce the person or body of the detenu viz., Deepika aged about 19 years, D/o.Sethulingam, from the illegal custody of the 4th and 5th respondents before this Court and set her at liberty. ORDER
[Order of the Court was made by R.SUBBIAH, J.] The mother of the detenu by name Deepika, D/o. Sethulingam, aged about 19 years has come with this Habeas Corpus Petition alleging that her daughter has been abducted by the 4th and 5th respondents on 07.11.2016. In this regard, the petitioner had already given a complaint to the 3rd respondent Police and based on the same, a case has been registered in Crime No.322 of 2016 https://hcservices.ecourts.gov.in/hcservices/
for women missing. As no steps has been taken by the respondents Police, she has come up with this petition.
2.Today, when the matter was taken up for hearing, the detenu was produced before this Court by the second respondent Police. When we enquired, the detenu told that she has not been abducted by anybody especially, the respondent Nos.4 and 5. She has further told that she is doing 2nd year B.E. course and since she is not interested in studying Engineering course, she went on her own to Tirupur and stayed there with her friends. Now, she wants to go with her mother viz., the petitioner. The said statement is recorded.
3.In view of the above, nothing survives for adjudication in this petition. Hence, this Habeas Corpus Petition is closed. Sd/- Assistant Registrar (Writs) /True Copy/ Sub Assistant Registrar To
