This Criminal Original Petition has been filed to direct the learned Judicial Magistrate No.II, Tiruchirappalli to dispose of the case in C.C.No. 1183 of 2019 within the stipulated period. 2.According to the petitioner, the petitioner is the defacto complainant in this case. Based on his complaint, a case has been registered by the respondent police in Cr.No.56 of 2016 against the accused persons. Though the case has been registered in the year 2016, so far case is pending without disposal. Therefore, seeks for speedy disposal this petition has been filed.
3.The learned Government Advocate (Crl.Side) would submit that based on the complaint of the petitioner, a case has been registered in Cr.No.56 of 2016 for the offence punishable under Sections 34, 120-B, 406, 417 and 420 IPC. After completion of investigation, they have filed the charge sheet before the concerned Court. In this case, all the witnesses were examined on the side of prosecution. Now the accused persons have filed a petition before the trial Court and the same is pending. It is for the trial Court to take appropriate decision in the 2/4
petition filed by the accused persons.
4.Considering the limited scope of the prayer sought for by the petitioner, long pendency of the case from the year 2019 and all the witnesses were examined on the side of prosecution, this Court hereby directs the learned Judicial Magistrate No.II, Tiruchirappalli to complete the trial proceedings in C.C.No.1183 of 2019 within a period of two months from the date of this order.
5.With the above direction, this Criminal Original Petition stands disposed of.
