PRAYER IN CRL MP(MD)No.14580/2022:

Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to suspend the sentence of Imprisonment imposed by the learned Additional District and Sessios Judge, kuzhithurai by the Judgment dt 17.08.2022 confirming the conviction and sentence imposed by the learned Judicial Magistrate No.II, Kuzhithurai in C.c.No.73/2010 by dated 15.05.2018 and enlarge the petitioner on bail, pending disposal of the Criminal Revision.

Prayer in CRL.R.C.(MD)No.1160 of 2022 :

Pleased to call for the records of the learned Additional District and Sessions Judge, Kuzhithurai in Crl.A.No.78 of 2018 by Judgment dated 17.08.2022, confirming the conviction and sentence of fine imposed by the learned Judicial Magistrate No.II, Kuzhithurai in C.C.No.73 of 2010 by the Judgment dated 15.05.2018 and set aside the Judgments of the courts below and acquit the petitioner. Order : This Criminal Miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.M.KARUNANITHI, Advocate for the petitioner and of MR.M.MUTHUMANIKKAM, Government Advocate(Crl.side) on behalf of the Respondent, the court made the following order:- This petition has been filed to relax the condition imposed on the petitioner in Crl.M.P(MD).No.14580 of 2022 in Crl.R.C(MD)No.1160 of 2022 dated 25.11.2022.

2. The learned counsel for the petitioner and Mr.M.Muthumanikkam, learned Government Advocate (Crl. Side) appearing for the respondent police are present before this Court.

3. The learned counsel for the petitioner submitted that the petitioner has been complying with the condition imposed by this court regularly.

4. The learned Government Advocate (Crl.Side) submitted that the petitioner has been complying with the condition regularly and also submitted that the investigation is going on.

5. Considering the nature and the gravity of offence, the condition imposed by this court in Crl.M.P(MD).No.14580 of 2022 in Crl.R.C(MD)No.1160 of 2022 dated 25.11.2022 is modified and the petitioner shall report before the concerned trial Court on the first working day of every English calendar month at 10.30 a.m., until further orders.
