ORDER
[Order of the Court was made by R.SURESH KUMAR, J.] This Habeas Corpus Petition has been filed to direct the respondents to produce the person or body of the detenues namely (1) Parvin Banu, aged about 26 years, D/o.Naina Mohammed (2) Mohamed Arasath S/o.Mohammed Abbas aged about 8 years and (3) Jarsira, S/o.Mohammed Abbas aged about 2 years before this Court, and set them at liberty.
2.Today, when the case was taken up for hearing, the respondent police have produced the detenues. When we enquired the first detenue, namely, Parvin Banu, she has stated that because of the torture she meted out at the hands of the third respondent, she was forced to leave the matrimonial home along with her children and reside with her parents, 2/4Page 2 of 4
ie., the petitioner herein. Even there, the torture of the third respondent continues. Therefore, she had gone to Ahmedabad, where she stayed in her friend's house along with her children, in search of a job for nearly two weeks. In the meanwhile, the police had gone and taken them and that is how, they have been brought before this Court. She would further submit that she wants to reside with the petitioner herein. The said statement is recorded and the first detenue along with her children, namely, 2nd and 3rd detenues, are permitted to go and stay with the petitioner herein.
