JUDGMENT
(Judgment of the Court was made by N.SATHISH KUMAR, J.) Challenging the order of the learned Single Judge directing the appellants to approve the appointment of the 2nd respondent/writ petitioner as Secondary Grade Teacher from 01.06.2020 onwards with all attendant benefits, the present appeal has been filed.
2. The writ petitioner was appointed as Secondary Grade Teacher in the 1st respondent school. According to her, she was appointed in the academic year 2016-2017. Since the staff fixation order also shows that the school was entitled to appoint one Secondary Grade Teacher, the 2nd respondent was appointed and approval was sought from 02.01.2017. The learned Single Judge taking note of the fact that staff fixation order at the relevant point of time provided only one Secondary Grade Teacher 2/5
and that post was filled by one R.N.Krishnan by the approval order with effect from 02.06.2014 and later, considering the subsequent staff fixation order for the academic year 2020-2021, took a view that since at that time, two Secondary Grade Teachers were sanctioned to the school apart from the Headmaster as per their own proceedings, has directed the authorities to approve the appointment of the writ petitioner.
3. We have also seen the staff fixation order for the academic year 2020-2021. Though earlier for the year 2016-2017, only one Secondary Grade Teacher was sanctioned, later in 2020-2021, two Secondary Grade Teacher were sanctioned. In fact, the order available in the typed set shows that apart from Malayalam Secondary Grade Teacher, the post of Secondary Grade Teacher(Tamil) has been sanctioned. Therefore, the appointment of the writ petitioner could not be approved at the relevant point of time. Later, two Secondary Grade Teachers were sanctioned as per the staff fixation order. Thus, we are of the view that the learned Single Judge is right in directing the authorities to approve the appointment of the writ petitioner as Secondary Grade Teacher from 01.06.2020 and also directing to consider the representation of the 3/5
petitioner seeking approval from the academic year 2016-2017. We do not find any infirmity in the said order.
4. Accordingly, the Writ Appeal stands dismissed. No costs. Consequently, connected miscellaneous petition is closed. [N.S.K., J.] & [M.J.R., J.] 12.06.2026 bala To
