O R D E R

This writ petition has been filed seeking the issuance of a writ of mandamus, directing the respondents 1 to 3 to consider and dispose of the petitioner's representation dated 18.03.2025 and consequently, not to survey the land comprised in Survey No.76/19 of Ponnavarayankotai Village, Pattukottai Taluk, Thanjavur District, till the disposal of the Second Appeal in S.A.(MD)No.829 of 2022 pending before this Court.

2. Heard the learned counsel for the parties and perused the materials available on record.

3. When the matter was taken up for hearing, the learned Special Government Pleader appearing on behalf of respondents 1 to 3 submitted 2/5

that the second respondent will consider and dispose of the petitioner's representation in accordance with law. However, the learned counsel for the petitioner submits that a civil dispute already exists with respect to the subject property and the Second Appeal in S.A.(MD) No. 829 of 2022 is also pending before this Court.

4. In view of the above submissions, without going into the merits of the matter, this Court directs the second respondent/Tahsildar to consider the petitioner's representation dated 18.03.2025, taking into account the fact that the civil dispute between the parties is still pending and dispose of the said representation either way, in accordance with the rules under the Tamil Nadu Land Survey and Boundaries Act, 1923. Such exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order. No costs. Consequently, the connected miscellaneous petition is closed.
