O R D E R

The writ petitioner filed this Writ Petition seeking for issuance of a Writ of Mandamus seeking direction to the Respondent No.2 to grant permission for Aadal Padal cultural program to conduct in the 'Sri Kaliamman Temple' function from 04/05/2023 to 09/05/2023 at North Ilanthaikulam Village, Kayathar Taluk, Thoothukudi District in par with the tradition which was followed for decades in that temple.

2. Mr. R.sureshkumar, learned Government Advocate (Crl. Side) takes notice for the respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself.

3. The learned counsel appearing for the writ petitioner submitted that festival for the temple, by name, " Sri Kaliamman Temple' at North Ilanthaikulam Village, Kayathar Taluk, Thoothukudi District, is going to be held on 01/05/2023 to 09/05/2023. Subsequent to the same, in order to conduct a cultural program from 04/05/2023 to 09/05/2023, they sought permission of the Police by giving a representation dated 12.04.2023. But, the second respondent has not considered the said representation. Since no order was passed, the writ petitioner has come 2/4

before this Court for the above said relief.

4. The learned Government Advocate (Crl. Side) appearing for the respondents would submit he has objected to grant permission to conduct the cultural program for six days and several cases have been registered against the village people. If the above said program is conducted, law and order problem will arise.

5. In view of the submission made by the learned Government Advocate (Crl. Side), if any problem is apprehended, the second respondent is directed to consider the representation made by the petitioner dated 12.04.2023 and pass appropriate orders on its own merits. So that the petitioner can workout the remedy through appropriate proceedings.

6. With the above direction, this writ petition stands disposed of. No costs.
