JUDGMENT

(Judgment of the Court was made by M.S.RAMESH, J.) By consent of both the counsels, the writ appeal is taken up for final disposal.

The present Writ Appeal is directed against the order passed by the Writ Court dated 03.08.2023 made in W.P(MD)No.18135 of 2023. 3.

The learned Special Government Pleader appearing for the appellants submitted that though the Writ Court had not gone into the merits of the case, had issued positive direction that the petitioner has to be promoted to the post of Night Watchman, which finding requires interference. He further submitted that during the final hearing of the writ petition, the respondent / writ petitioner had only requested for consideration of his representation dated 04.07.2023, wherein, he had sought for accommodating him in the vacant post of Night Watchman and not for promotion and that his representation could be considered in accordance with law.

In the light of the submissions made, the order impugned in W.P(MD)No.18135 of 2023, dated 03.08.2023, is set aside insofar as the positive direction for promotion of the respondent. However, there shall be a direction to the appellants to consider the respondent's representation dated 04.07.2023, wherein, he had sought for accommodating him in the vacant post of Night Watchman, on its own merits and pass appropriate orders in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
