Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus, directing the 1st respondent herein to cancel the forged patta vide Doc.No.RIPT No.8/1407 dated 16.12.1997 and restore it in the petitioner's husband name by considering and dispose the petitioner's representation dated 19.03.2021, within the time frame that may be stipulated by this Court.

ORDER

This Writ Petition has been filed for the issue of a Writ of Mandamus directing the first respondent to pass final orders in the appeal filed by the petitioner within the time frame fixed by this Court.

2. The case of the petitioner is that her husband was allotted properties in Survey Nos.179/1E and 187/2A2 at Thamarakki North Group, Sivagangai Taluk, Sivagangai District. The further case of the petitioner is that the third respondent had created forged documents and had illegally transferred the patta in her name with respect to both the properties in the year 1997. The same came to the knowledge of the petitioner and hence, a representation was made to the first respondent on 19.03.2021 seeking to cancel the patta issued in favour of the third respondent. Since the same was not considered, the present Writ Petition has been filed before this Court seeking for appropriate directions.

W.P.(MD).No.11694 of 2021 petitioner and Mr.M.Lingadurai, learned Government Advocate appearing for the respondents 1 and 2.

Taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to the first respondent to consider the representation made by the petitioner on 19.03.2021 after affording opportunity to the petitioner and the third respondent and deal with the same on its own merits and in accordance with law and pass final orders within a period of six weeks from the date of receipt of a copy of this order.

5. The petitioner is directed to make a fresh representation to the first respondent along with all the relevant documents and also a copy of this order.

6. This Writ Petition stands disposed of with the above directions. No costs.
