Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 and 2 to take action against the 3rd respondent, for his biased and unlawful activities against the petitioner, on the basis of the petitioners complaint dated 17.04.2023 within the stipulated time to be fixed by this Court. O R D E R

Heard the learned counsel for the writ petitioner and learned standing counsel for the respondents 1 and 2. 2.The petitioner has given a complaint against the third respondent. The petitioner wants this Court to direct the employer to take disciplinary action against the third respondent. I have consistently taken the view that it is not for the Writ Court to direct the employer to initiate disciplinary action against the erring employee. The issue is left 2/4

entirely to the discretion of the second respondent. Now that the second respondent is cognisant of the petitioner's complaint, it is for the second respondent to take a call in the matter.
