Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a WRIT OF MANDAMUS directing the 2nd respondent to consider the petitioner's representation dated 24.10.2025 within a time frame that may be stipulated by this Court and directing the 2nd respondent to cancel the erroneous Patta No. 5275 on the file of the 3rd respondent, and the same to restore the patta in the names of the rightful legal heirs of late Alagammal namely Rajeshwari (W/o Palanisamy) and Alagumani (W/o Ashokan).
ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the 2nd respondent to consider the petitioner's representation dated 24.10.2025 within a time frame that may be stipulated by this Court and to direct the 2nd respondent to cancel the erroneous Patta No. 5275 on the file of the 3rd respondent, and the same to restore the patta https://www.mhc.tn.gov.in/judis
in the names of the rightful legal heirs of late Alagammal namely Rajeshwari (W/o Palanisamy) and Alagumani (W/o Ashokan).
2.Based on the petitioner's application, the official respondents have issued notice dated 26.11.2025 but it is seen that said notice is issued only for the petitioner alone. The official respondents ought to issue notice to the 4th respondent also. 3.Therefore, this Court is directing the second respondent to conduct an enquiry after issuing notice to the petitioner and the 4th respondent. The 2nd respondent shall also provide personal hearing to the parties and thereafter, pass appropriate orders in accordance to law within a period of four months from the date of receipt of a copy of this order. 4.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
