Crime No.271 of 2026 .....Respondents Prayer :Petition filed under Article 226 of the Constitution of India to issue a writ of Habeas Corpus to direct the respondent Nos.1 and 2 to secure the person or body of the petitioner's mother Rajalakshmi, aged 37 years and produce her / body before this Court and set her at liberty.

ORDER

(Order of the Court was made by N. ANAND VENKATESH,J.) This Habeas Corpus Petition has been filed for a direction to the respondents to secure the person or body of the petitioner's mother and to set her at liberty.

2. Heard the learned counsel on either side.

3. The case of the petitioner is that her mother left for work on 16.02.2026 and she did not return back in the evening and thereafter, the petitioner was not able to trace her whereabouts. A complaint was given to the second respondent, based on which a woman missing FIR was registered on 19.02.2026 in Crime No.271 of 2026. The grievance of the petitioner is that till date, no effective steps have been taken to ascertain the whereabouts of the petitioner's mother. Therefore, the present Habeas Corpus Petition has been filed.

4. The learned Additional Public Prosecutor on instructions submitted that the petitioner's mother had an extra matrimonial affair with one Kali and she has gone along with him.

5. Taking into consideration the facts and circumstances of the case and considering the submissions made on either side, there shall be a direction to the second respondent to produce the detenue before the learned Judicial Magistrate No.II, Thoothukudi. On that day, the petitioner shall also be put on notice. The learned Judicial Magistrate shall record the statement of the detenue and proceed further in accordance with law.
