5204/A3/2022 dated 03.04.2023 cancelling the sale deed vide document No.919 of 2021 executed in the petitioner's favour and its parent Documents No. 2352/2008, 2478/2008 and 208/2010 on the file of the 2nd respondent and quash the same as illegal.

ORDER

This Writ Petition has been filed for the issuance of a Writ of Certiorari, to quash the impugned order issued by the 1st respondent dated 03.04.2023.

2. The present impugned order was passed under Section 77A of the Registration Act. The respondents are not having right or jurisdiction to entertain any petition under Section 77A of the Registration Act, as it has been held to be ultra vires.

3. Accordingly, this writ petition is allowed. The impugned impugned order issued by the 1st respondent dated 03.04.2023, is hereby quashed. The parties are at liberty to approach the competent civil court to agitate their 2/4

rights. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
