PRAYER : Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the 5th respondent to register a case under POCSO Act as per this Court order in HCP(MD)No.2067 of 2022 dated 20.01.2023 and to take action against the 6th respondent on the basis of petitioner's representation dated 14.04.2023. For Petitioner : Mr.A.Vadivel For Respondents : Mr.B.Nambiselvan Additional Public Prosecutor O R D E R This Writ Petition is filed to direct the 5th respondent to register a case under POCSO Act as per this Court order in HCP(MD)No.2067 of 2022 dated 20.01.2023 and to take action against the 6th respondent on the basis of petitioner's representation dated 14.04.2023.

The learned Additional Public Prosecutor would submit that on the basis of the complaint given by the petitioner, originally the case was registered in Crime No.518 of 2022 under the girl missing caption on 26.11.2022. During the course of investigation, it was found that the offences are punishable under the provisions of POCSO Act, so that, the alteration report was made on 23.12.2022, after that the accident register was made on 13.03.2023 and investigation is undertaken on that line. 2/4

3. Recording the submission made by the learned Additional Public Prosecutor, the matter is become infructuous. Even though some sort of grievance is expressed by the petitioner against the sixth respondent, which may not be considered at this stage.
