PRAYER :- For Bail in Crime no.55/2023 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner /sole accused who was arrested and remanded to judicial custody on 18.02.2023 for the offences under sections 376 and 506(2) of IPC in Crime No.55 of 2023 on the file of the respondent police seeks bail.
2. The case of the prosecution is that on 18.02.2023 at about 1.30 pm., when the defacto complainant was waiting in the bus stand, the petitioner came there in a two wheeler and picked up her and forcibly raped her and threatened her, hence the case.
3. Heard both sides and perused the materials available on record including the First Information Report.
4. This is the second application for bail and the earlier application for bail was dismissed by this Court on 31.03.2023 in Crl.O.P(MD) No.6056 of 2022 and there is no change in circumstances https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.7856 of 2023 of the case to consider the present bail petition even after dismissal of the petition, hence this court is not inclined to grant anticipatory bail to the petitioner.
