ORDER : The Court Made the following order :- The petitioner, who is arrayed as sole accused, apprehending arrest at the hands of the respondent police for the offences punishable under Sections 366(A) IPC altered into Section 5(a), (4), (5(i) 6 of POSCO Act in Crime No.4 of 2018 and Section 4 of Dowry Prohibition Act in Crime No.34 of 2017, on the file of the respondent police, seeks anticipatory bail.
2.The petitioner filed an undertaking affidavit that he would marry the victim girl on attaining the age of majority, if she is willing.
4. Heard the learned Government Advocate (Crl.side) appearing for the State.
5.Recording the above undertaking, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. It is made clear that if the said undertaking is breached, it is open to the victim girl to initiate contempt of Court proceedings against the petitioner. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate Court Eraniel, Kanyakumari District, and on his executing a bond for a sum of Rs.10,000/- https://hcservices.ecourts.gov.in/hcservices/
(Rupees Ten Thousand only) with two sureties for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.
6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail shall stand dismissed.
