ORDER
This Civil Miscellaneous Petition has been filed to condone the delay of 453 days in filing the Appeal Suit in A.S.(MD)SR No.29789 of 2026 before this Court.
2. Heard the learned counsel appearing on either side and perused the affidavit filed in support of this petition.
3. Counter affidavit of the sole respondent has already been filed.
4. The learned counsel for the sole respondent submitted that this petition may be allowed by imposing costs on the petitioner.
5. Being satisfied with the reasons stated in the affidavit, and also considering the submission made by the learned counsel for the sole respondent, this Court is inclined to allow this petition on payment of costs. Accordingly, this Civil Miscellaneous Petition is allowed on 2/4
payment of costs of Rs.3,000/- (Rupees Three Thousand only) by the petitioner to the sole respondent on or before 24.06.2026, failing which this petition shall stand automatically dismissed without any further reference to this Court.
