Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a writ of mandamus, to direct the 1st respondent herein to take appropriate action as against the 2nd respondent herein for misuse of his official power in favour of respondents 3 and 4 herein as well as not register FIR on the petitioner's complaint as per the dictum laid down by Hon'ble Apex Court in Lalithakumar vs. Government of Uttarpradesh and others reported in 2014 (2) SCC Page 1 within a stipulated period as may be fixed by this Court.

On 10.01.2022, when the matter was taken up, this Court directed the Superintendent of Police, Karur to file a detailed status report.

2. As directed by this Court, today, the Deputy Superintendent of Police has filed status report. From the report it appears that the petitioner, who has alleged that he was forcibly evicted from the premises has not turned up for enquiry personally, https://hcservices.ecourts.gov.in/hcservices/ _____________ Page Nos.1/2

W.P.(MD)No.10059 of 2019 but only his counsel appeared and his complaint found to be incorrect. In view of the money transaction, earlier, possession of the property was given to the respondents 3 and 4, later EOW, Karur, has taken possession of the property and persently, the property is in possession of the EOW, Karur in Crime No.2 of 2020.

3. In view of the above fact, nothing survives in this writ petition for further adjudication. Accordingly, this writ petition stands dismissed. No Costs.
