Petition filed under Article 226 of the Constitution of
India, praying for issuance of a writ of Habeas Corpus to direct the respondents 1 and 2 to produce the person or body of the petitioner's son Pandiyarajan, son of Duraipandi, aged about 31 years before this Court and set him at liberty. For Petitioner :Mr.V.A.Dhana Aravindha Balaji for M/s.Dhana Law Associates For Respondents :Mr.A.Ramar Additional Public Prosecutor COMMON ORDER (Order of the Court was made by M.V.MURALIDARAN, J.) One Mr.Ramachandran has filed HCP No.319/2016 alleging that his wife by name Bharathi was found missing from 28.01.2016 and a complaint has been given by the petitioner and upon which, a case has been registered in Crime No.5/2016 for 'woman missing'.
2. One Mr.Durairaj has filed HCP No.432/2016 alleging that his son by name, Pandiyarajan, aged 31 years, was found missing from 28.01.2016.
3. Today, when both the petitions were taken up, the learned Additional Public Prosecutor states that the third respondent Pandiarajan in HCP No.319/2016 is the detenu in HCP No.432/2016. The detenu in HCP No.319/2016, viz., Bharathi eloped with the third respondent Pandiarajan and on the complaint preferred by the petitioner in HCP No.432/2016, a case has been registered in Crime No.1035/2016 for 'man missing'. He would further submit that both cases registered in Crime Nos.5/2016 and 1035/2016 are pending investigation.
4.Recording the said submission, these petitions are closed directing the respondent police to expedite the investigation.
