This Criminal Original Petition has been filed to direct the learned Judicial Magistrate No.III, Tuticorin, Tuticorin District to dispose of the case in C.C.No. 854 of 2017.
2.According to the petitioner, the petitioner is the A1 in this case. Based on the complaint of the defacto complainant, a case has been registered by the 3rd respondent police in Cr.No.117 of 2012 against the petitioner and other accused persons. Though the case has been registered in the year 2012, so far case is pending without any disposal. Therefore, seeks for speedy disposal and this petition has been filed. 3.The learned Government Advocate (Crl.Side) would submit that based on the complaint of the defacto complainant, a case has been registered in Cr.No.117 of 2012 for the offence punishable under Sections 4(1-A), 4(1)(aaa) of TNP Act. After completion of investigation, they have filed the charge sheet before the concerned Court. In this case there are totally 11 witnesses and so far, 9 witnesses were examined. The case is posted for examination of further witnesses. The respondent police is ready to produce the witnesses as directed by 2/4
the trial Court and co-operate to complete the trial proceedings. 4.Considering the limited scope of the prayer sought for by the petitioner and also considering the long pendency of the case, this Court hereby directs the learned Judicial Magistrate No.III, Tuticorin, Tuticorin District to complete the trial proceedings in C.C.No.854 of 2017 as early as possible without giving long adjournments, beyond 1 week.
5.With the above direction, this Criminal Original Petition stands disposed of.
