PRAYER :- For Anticipatory Bail in Crime No.91 of 2023 on the file of the respondent police ORDER : The Court made the following order :- The petitioner/A3, who apprehends arrest at the hands of the respondent police for the offences punishable under sections 109 and 309 of IPC in Crime No.91 of 2023 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the defacto complainant's daughter was studying B.Sc., Nursing in Sakthi Nursing College, Oddanchatram. On 21.02.2023, the defacto complainant received a phone call from the Principal of the said College and he was informed that his daughter fell down from staircase and she is admitted in the hospital. Thereafter, the defacto complainant rushed to the hospital and his daughter was in serious condition. Hence, he lodged a complaint stating that his daughter committed suicide due to harassment made by her roommates including the petitioner and the college administration failed to take any step to prevent his daughter from committing suicide. 3. The learned counsel for the petitioner submitted that the 1/2
CRL OP(MD). No.7749 of 2023 petitioner is an innocent person and she has been falsely implicated in this case.
4. Heard both side and perused the materials available on record including the First Information Report.

It is seen from the statement recorded from one Tamilarasi, who is neighbor room student of deceased, that the first accused by name Keethana/petitioner fell in love with one boy and she also spoken with him through video call, the same was informed by the deceased to her mother. Thereafter, A1 along with other two roommates tortured the victim girl. Therefore, she went to neighbor room namely one Tamilarasi and when the said Tamilarasi questioned from the deceased, she disclosed the aforesaid facts. Thereafter, she got humiliate and jumped from the first floor of the College, sustained grievous injuries and died. That apart, there was suicide note written by the victim, which is also corroborated with the statement recorded from the neighbor room student Tamilarasi. Therefore, the custodial interrogation of the petitioner is very much required. Accordingly, this Criminal Original Petition stands dismissed.
