Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records relating to the impugned letter issued by the 3rd respondent in letter No.Na.Ka.No.1330664/2025/B1 dated 10.03.2025 and setting aside the same and consequently direct the respondents to consider the claim of the petitioner for medical reimbursement of Rs.75,507/- and disburse the same to the petitioner.

ORDER

This writ petition has been filed challenging the impugned letter issued by the 3rd respondent in letter No.Na.Ka.No.1330664/2025/B1 dated 10.03.2025 and also to direct the respondents to consider the claim of the petitioner for medical reimbursement of Rs.75,507/- and disburse the same to the petitioner.

2. Heard the learned counsel on either side and perused the materials placed before this Court.

The petitioner, who is working as Headmaster, has sent a representation to the fourth respondent, seeking reimbursement of the medical expenses incurred for his son, who took treatment in Apollo hospital for dengue fever from 30.07.2023 to 03.08.2023. However, the same was rejected stating that diagnosis and line of management is not covered and hence, the claim cannot be considered. Thereafter, the petitioner made the same claim to the respondents 1 to 3 and the same was also rejected by the third respondent vide order dated 10.03.2025 stating that the claim ought to have been submitted before 31.12.2024. Challenging the same, this writ petition came to be filed.

The learned counsel appearing for the petitioner would submit that during the pendency of this writ petition, the District Level Empowered Committee recommended the case of the petitioner for disbursement of the medical claim to the Commissioner of Treasuries, Chennai, vide order dated 08.07.2025.

5. The learned Additional Government Pleader appearing for the respondents 1 to 3 would submit that the first respondent made a recommendation to the Commissioner of Treasuries, Chennai, by whom the eligible medical claim amount has to be paid to the petitioner.

Considering the facts and circumstances of this case, the Commissioner of Treasuries and Accounts, 3rd floor, Anna Salai, Nandanam, Chennai - 600 035, is suo motu impleaded as 5th respondent in this writ petition and the newly impleaded 5th respondent is directed to disburse the eligible amount as per the recommendation made by the first respondent within a period of six weeks from the date of receipt of a copy of this order.

7. With the above direction, this writ petition is disposed of. There shall be no order as to costs.
