PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the 2nd respondent to disburse loan amount of Rs.5,01,600/- to the Petitioner on the basis of the 1st respondent orders No. Na.Ka.No.TAHDCO-2019 -20 EDP-KR-39 , dated 15.12.2020.

O R D E R

This writ petition has been filed for the issue of writ of mandamus directing the second respondent to act upon the recommendation made by the first respondent through letter dated 15.12.2020 and to disburse the loan amount to the petitioner.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the first respondent. The second respondent has been served with notice and there is no representation either in person or through counsel.

3. The petitioner belongs to the Scheduled Caste community and she wanted to start a business under the Entrepreneur Development Programme Scheme. Accordingly, an application was made before the first respondent. The first respondent called upon the petitioner and conducted an interview. Ultimately, the first respondent through letter dated 15.12.2020 recommended to the second respondent Bank to disburse the loan amount to the petitioner. Pursuant to the same, the petitioner also approached the second respondent seeking for the disbursement of the 2/4

loan. Since the amount was not disbursed, the present writ petition has been filed before this Court.

Taking into consideration the facts and circumstance of the case and the recommendation that has already been made by the first respondent through letter dated 15.12.2020, there shall be a direction to the second respondent to act upon the same and disburse the loan amount to which the petitioner is entitled within a period of four (4) weeks from the date of receipt of a copy of this order. The petitioner is directed to make a fresh representation to the second respondent along with all the relevant documents and also a copy of this order.

5. This Writ Petition is disposed of with the above directions. No costs.
