PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the learned Subordinate Judge, Eraniel, to expedite and complete the trial in S.C.No.67/2021 pending on the file of the learned Subordinate Judge, Eraniel, Kanyakumari District and dispose of the case within a time frame that may be fixed by this Court.

ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders to direct the learned Subordinate Judge, Eraniel, to expedite and complete the trial in S.C.No.67 of 2021 pending on the file of the learned Subordinate Judge, Eraniel, Kanyakumari District and dispose of the case within a time frame that may be fixed by this Court.

2. The learned Government Advocate (Crl. Side) would submit that the third accused is reported to be dead.

3. Considering the oldness of the crime, there shall be a direction to the learned Subordinate Judge, Eraniel, Kanyakumari District, to speed up the process of Final Report and to complete the same within five months from the date of receipt of copy of this order. Since the third accused is reported to be dead, charge made against him is abatted. 2/4

4. With the above said direction, this Criminal Original Petition is disposed of. Consequently, connected Miscellaneous Petition is closed. 08.06.2023 NCC :
