Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to transfer the investigation of the case in Cr No. 31/2024 pending on the file of the 7th Respondent Police to any other independent agency or CBCID officer under the direct supervision of the 3rd Respondent and further to file the final report in the said case within a reasonable time period to be fixed by this Court. O R D E R

The petitioner /A2 in Crime No.31 of 2024 on the file of the S.P.Pattinam Police Station, Ramanathapuram District has approached this Court for transfer of investigation in the above Crime number to any other investigating Agency under the direct supervision of the Superintendent of Police, Ramanathapuram.

2.This Court is of the view that the accused is not entitled to choose the investigation agency for his own whims and fancies. If the 2/5

final report is filed as against this petitioner, it is always open to him to demonstrate his case before the trial Court or he can file a quash application, challenging the final report.

3.In view of the above, this Court is not inclined to interfere with the investigation, that too, at the instance of an accused in Crime No.31 of 2024 on the file of the seventh respondent in a case under NDPS Act.
