PRAYER :- For Anticipatory Bail in Crime No.76 of 2023 on the file of the respondent Police.
ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent Police in 1/3
connection with a case in Crime No. 76 of 2023, for the offence under Sections 294(b), 323, 324 and 506(ii) IPC, seeks anticipatory bail.
2. The case of the prosecution is that on 22.12.2023, when the defacto complainant was returning to home, the accused persons tried to dash his vehicle and subsequent to that, there was a wordy quarrel between them, due to which, the accused persons abused the defacto complainant in filthy language, attacked him with hands and also threatened him with dire consequences. Hence, the case.
3. The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. However, he has been falsely implicated in this case.
4. The learned Additional Public Prosecutor submits that the petitioner is having six previous cases and considering the antecedent of the petitioner, the earlier anticipatory bail petitions filed by the petitioner were dismissed by this Court. This is the fourth petition filed by the petitioner seeking anticipatory bail.
5. Considering the antecedent of the petitioner and since there is no change in circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. 2/3
