For Respondent : Mr.R.Erottuchamy, Government Advocate (Crl.Side) PETITION FOR MODIFICATION Under Sec.439(1)(B) of Cr.P.C. PRAYER :- To Modify the condition order that the petitioner shall appear and sign before the learned Judicial Magistrate Court No.4, Madurai, at 10.00 A.M. Until further orders in Crl.M.P.No.3750 of 2020 by order dated 26.08.2020.

ORDER : The Court made the following order :- This petition has been filed to modify the condition imposed by the learned Judicial Magistrate No.IV, Madurai in Crl.M.P.No.3750 of 2020 dated 26.08.2020.

2. The learned counsel for the petitioner would submit that earlier the petitioner was granted bail by the learned Principal District Judge, Madurai on 04.05.2020 with a condition to report before the respondent police daily at 10.00 a.m until further orders and thereafter the petitioner has filed another petition for modification of the said condition before learned Principal District Judge, Madurai on 26.08.2020 and learned Judge had modified the condition to the effect that the petitioner shall report before the learned Judicial Magistrate No.IV, Madurai at 10.00 a.m.,until further orders. He would further submit that the petitioner is the only sole bread winner of the family and he is appearing before the concerned Court regularly. Hence he seeks modification of the said order.

3. The learned Government Advocate(Crl.Side) appearing for the respondent police would submit that the petitioner is complying with the condition regularly without any deviation.

4. Considering all the above facts and circumstances of the case, the condition imposed by the learned Judicial Magistrate No.IV, Madurai in Crl.M.P.No.3750 of 2020 dated 26.08.2020 directing the petitioner to appear before the learned Judicial Magistrate No.IV, Madurai at 10.00 a.m.,until further orders is modified to the effect that the petitioner shall report before the respondent police once in a week on every Monday at 10.30 a.m., until further orders.

5. With the above modification the petition is ordered accordingly.
