To issue a direction, directing to transfer the amount a sum of Rs.37,14,359 (Rupees Thirty Seven Lakhs Fourteen Thousand Three Hundred Fifty Nine Only) Vide UTR No.12242832829260 and No.12242832829262 dated 12.01.2024 which was deposited by the Appellant / 2nd respondent/ Insurance company before this Court to the Motor Accident Claim Tribunal (Principal District Judge), Karur.
ORDER
(Order of the Court was made by the Hon'ble P.B.BALAJI) This petition has been filed seeking transfer of the amount of Rs.37,14,359 (Rupees Thirty Seven Lakhs Fourteen Thousand Three Hundred and Fifty Nine Only) which has been deposited vide UTR Nos.12242832829260 and 12242832829262 dated 12.01.2024 by the second respondent / Insurance Company before this Court pursuant to the Judgment passed in CMA(MD).No.1275 of 2023 dated 04.12.2025.
2. The petitioners now seek transfer of the said amounts for the purpose of seeking withdrawal before the Tribunal.
3. Admittedly, the amount has been deposited before this Court in CMA.(MD).No.1275 of 2023 lying in the Indian Bank, High Court Branch, Madurai. We do not see any useful purpose in transferring the said amount to enable the petitioners to withdraw the amounts thereafter. Admittedly, the Insurance Company has no objection for the amounts being paid out to the petitioners and hence, we are of the view that the petitioners may be given liberty to seek withdrawal of the amount of Rs. 37,14,359/- from which has been deposited vide UTR Nos. 12242832829260 and 12242832829262 dated 12.01.2024 before the Indian Bank, High Court Branch, Madurai. The petitioners shall coordinate with the Registry / Account Section and comply with the necessary formalities before becoming entitled to withdraw the said amount.
4. This petition is disposed of accordingly.
